I resolved the case of John and Terri S.v. Roe Trucking. I was assisted in this case by my colleague Todd A. Porter of the Law Office of Todd A. Porter. The initial settlement offer was $500,001.00; the offer was rejected by my firm. The Defendant truck driver made a dangerous left hand turn from Highway 101 onto Wells on a Road in Paso Robles, California, causing to the death of four people, including the son of my clients. Defendants blamed the accident on the drug impairment of the driver of the on coming car. My firm encouraged the District Attorney’s office to prosecute the truck driver, ultimately leading to a six year prison sentence. Defendant trucking company destroyed evidence to prevent Plaintiffs’ attorneys from obtaining critical records. Mr. Porter and I conducted an intensive investigation into the corrupt and illegal business practices of the trucking company, resulting in a significant exposure to punitive damages should the case be tried. Mr. Porter and I relentlessly pursued punitive damages against the driver and the trucking company, arguing that Defendant trucking company facilitated the continued operation of a dangerous vehicle on a public highway. After a two and a half year battle, the case settled 25 days prior to trial, at a second mediation, for $4,500,000.00.
